1. Scope of Application
These General Terms and Conditions ("Terms") apply when you connect and interact with our websites, mobile applications, and other products and services (collectively, the “Services”), when you contact our customer service team, engage with our community on social media, or otherwise interact with us. The version of the Terms valid at the time of the conclusion of a contract shall apply.
3. Prohibitions on User Content and Conduct
When using the Services, you are solely responsible for your conduct and User Content. You assure not to do any of the following:
- Post, upload, create, store, publish, submit, transmit, or otherwise make available any User Content that: (i) encourages acts of violence or threats of violence against any person or entity; (ii) is dishonest, false, deceptive, or fraudulent; (iii) is violent or threatening or encourages acts of violence or threats of violence against any person or entity; (iv) may or does violate a third party's rights to patents, copyrights, trademarks, trade secrets, moral rights, or other intellectual property rights; (v) pretends to be someone else or misrepresents your affiliation with any organization or individual; or contains or portrays any remarks, statements, or assertions that do not accurately represent your opinions and experiences; (vi) is indecent, lewd, suggestive, abusive, inflammatory, vulgar, offensive, unlawful, libelous, and/or obscene; (vii) encourages the use of illegal or harmful substances; (viii) is objectionable, prevents another person from using or enjoying the Services, or could expose Restful Mind or others to any kind of harm or liability; (ix) violates or encourages any conduct that would be considered a violation of these Terms, any party's rights, or any applicable local, state, federal, or international law or regulation; or that would result in civil or criminal liability; (x) is proprietary and for which you lack the legal authority to disclose or grant us the aforementioned license; (xi) contains any viruses, corrupted data, or other harmful, disruptive, or destructive files or content; or (xii) contains any unsolicited or unauthorized political campaigning, advertisements, solicitations, or promotions;
- Use the Services in a way that is prohibited by these Terms, that deviates from their intended use, that violates any applicable law, rule, contract, intellectual property right, or other third-party right, that could interfere with, disrupt, negatively impact, or prevent other users from enjoying the Services to the fullest extent possible, or that may in any way harm, disable, overload, or impair the functionality of the Services;
- Deciphering, decompiling, disassembling, or reverse engineering any software that the Services are provided by, or taking any action that might lead to the discovery of source code;
- Modify the Services, take down any labels or notices of proprietary rights, or create any other derivative works using the Services;
- Use another user's account or attempt to use one without that user's and Restful Mind's permission;
- Create or utilize any applications that communicate with the Services without getting our approval in writing previously;
- Without their express consent, gather or retain any personally identifiable information from other Service users;
- Copying, redistributing, using, displaying, mirroring, or framing the Services, or any specific component of the Services, Restful Mind's name, any trademark, logo, or other proprietary information, or the form and layout of any page or form contained on a page, without the express written permission of Restful Mind or its licensors;
- Avoid, evade, disregard, eliminate, deactivate, impede, unscramble, or otherwise get around any technological safeguards put in place to protect the Services by Restful Mind, any of her suppliers, or any other third party (including another user);
- Participate in any actions that are predatory, intimidating, threatening, harassing, or stalking;
- Interfere or attempt to interfere with any user's, host's, or network's access; instances of such actions include virus distribution, overloading, flooding, spamming, or mail-bombing the Services;
- or Allow or encourage someone else to carry out any of the aforementioned actions.
We maintain the right, at any time and for any reason without advance notification, to monitor access to or use of the Services, as well as to examine and edit any User Content. We reserve the right, but are not required to, enforce this section to the extent allowed by applicable law by deleting or blocking access to any User Content, at any time and without prior notice, including, but not limited to, if we, in our sole discretion, believe that any User Content violates these Terms. We do not forfeit our right to enforce this section in other situations just because we choose not to do so in some of them. We reserve the right to look into behavior that interferes with the Services or violates these Terms. In order to prosecute users who dissolve the law, we may additionally confer with and work with law enforcement. Furthermore, no third party may assert a private right of action through this section, and there is no reasonable expectation that any User Content that is forbidden by these rules will be present on the Services.
